Making the purchase and confirming it makes you a customer and implies full and complete acceptance of these Terms and Conditions, as well as acceptance of the rest of the Legal Terms of the Website and Regulations and any others expressly indicated by the Escuela Náutica Neptuno.

3. PURCHASE CONDITIONS

Keep in mind that, in some cases, the availability of our Products and/or Services may depend on many factors, such as the number of students who enroll, the places offered, availability of a specific boat or any other circumstance that We will indicate on our website at the time of contracting.

5. HOW TO MAKE A PURCHASE

You can buy our Products and/or Services both online through our Website, and in person, following the procedure that will be indicated in each case.

To make an online purchase, you must follow the purchase procedure that we will indicate to you through our Website, completing all the fields that appear as mandatory in the different forms of our Products and/or Services and selecting what you wish to purchase, remaining thus entering the order in the shopping cart.

Likewise, you can purchase our Products and/or Services in person at the address that appears at all times on the Website, where we will inform you in greater detail of the applicable conditions.

6. WHAT DO WE OFFER?

Recreational nautical courses

Each of these Courses may have a theoretical and a practical component, depending on the Course. The theoretical part can be offered both in person and online through the Zoom platform, as long as this option exists in the chosen Course at the time of purchase. Internships can be booked through the online campus or at the time of hiring and can be carried out before or after the completion of the theoretical component, depending on availability.

Depending on what is selected, from the Neptuno Nautical School we will send you access to the online campus within 24 hours of processing your order. If the course includes the sending of teaching material by postal mail, it will be sent within 7 calendar days. Keep in mind that, depending on the geographical location of your home, the shipping time and shipping costs may vary.

The specific modality, dates and price of each Course is published on our Website that you can consult at the time of Purchase.

As a User, you must bear in mind that some of the Courses may be subject to additional prior legal requirements, such as mandatory prior training, so you must carefully read the information we offer on our Website when making the Purchase.

The user is obliged to pay the total amount of the course. Lack of attendance will not give the right to request any refund.

As a user, you must keep in mind that both the approved theoretical exams and the practices carried out have an expiration date officially set by the administration, in the event that the degree is not processed within the deadlines detailed below:

“The student will have 24 months from completing the first practice to pass the theoretical exam and process the degree. Likewise, if you pass the exam first, you will have 24 months to complete the internship and process the degree.”

After these deadlines, the expiration occurs and the course and/or internship must be taken again. The Neptuno Nautical School does not assume any responsibility in this regard, and it is the student who must carry out the procedure, or hire the School to manage it, with a sufficient management period (minimum 8 weeks before expiration occurs). paying the amount of expenses and management and providing the necessary documentation.

Internship cancellation policy:

Attendance is mandatory. If you cannot attend, the cancellation costs will be as follows (to be paid in order to rebook the practice):

• Approved navigation, sailing and/or radio communications practices. If canceled with less than 3 calendar days, €50

• 24h or 48h cruise: . If you cancel with less than 10 calendar days, you must pay €150 if the practice was a 24-hour cruise. or €250 if it was a 48-hour cruise. If they are canceled with less than 72 hours or you do not show up for the practice, you must pay the full amount of the practice.

• Onboard training cruise: If canceled with less than 15 calendar days, the cost to rebook will be €500. If they are canceled with less than 72 hours or you do not show up for the practice, you must pay the full amount of the practice.

In the event that the place is occupied after the cancellation, only 10% of the established penalty will be charged.

When the service is canceled by La Escuela Náutica Neptuno, the student will have the right to receive a 100% refund of the amount paid, or to select any other available date, as long as the student has not canceled or partially consumed another course in advance, in which case you will have the right to reschedule it by selecting another date, but not to receive any refund.

Likewise, the user will have the right to reschedule the date but not to be reimbursed in those cases in which the cancellation of the service by the School is due to circumstances beyond its control (for example, meteorology), or due to indications to it. effect received from the competent administrations and/or organizations (example: prohibition of navigation by the Generalitat, Maritime Captaincy, Salvage, etc.). In the latter case, if the student sufficiently demonstrates that he or she will not be able to do the practice on any other date, he or she will be refunded a maximum of the amount equivalent to the practice not carried out.

Professional courses (STCW)

We offer the approved professional training courses through Yacht Charter World S.L.

The professional training courses consist of a theoretical and a practical component, depending on the Course. When you make the Purchase you must carefully read what is established in the description of each Course to know its details and the modules and practices that it includes, if applicable. The theoretical part can be offered both in person and online through our Platform only when the option to do it online is expressly indicated in the chosen Course at the time of Purchase.

The specific modality, dates and price of each Course is published on our Website that you can consult at the time of Purchase.

Keep in mind that both the theoretical and practical components will have specific completion dates, so you must make sure you have availability on those dates.

As a User, you must bear in mind that some of our Courses may be subject to additional legal requirements, such as mandatory prior training or mandatory attendance at training, so you must carefully read the information we offer on our Website when making the Purchase.

Sailing Club

Neptuno Navigation Club Base Member Program

At the Neptuno Nautical School we offer you the option of joining our navigation club (“Neptuno Navigation Club”) so that you can navigate through a monthly fee of 50 euros and without a commitment to stay. This price is equivalent to 5 Bronze credits. The Member of the BASE MEMBER program may redeem their credits by choosing from all activities, events and trips programmed by the NEPTUNO NAVIGATION CLUB. To do this you will have access to the Neptuno Navigation club computer application (http://neptuno.nauticsoft.com).

The price and particular conditions of each activity will be described on the web platform.

Unused credits can be accumulated for use in subsequent months and will be valid as long as the monthly subscription remains valid. Once the subscription is cancelled, the right to use the remaining credits is lost.

The contracting of the base membership program will be carried out through our website, by credit card. For cancellation, notice must be given at least 15 calendar days in advance. Yacht Charter World SL reserves the right to cancel subscription to the base membership program at any time.

Cancellation policy:

The member can cancel the reserved nautical activities (sailing trips) from the online platform or by contacting info@neptuno.es, respecting the deadlines of the cancellation policy. Otherwise, except due to force majeure, the proportional credits will be considered lost.

The generic cancellation policy, except for specific conditions that will be indicated in the information of each trip/event, is reflected in the following table, indicating the credits to be refunded in the event of cancellation by the member:

Yacht Charter World SL reserves the right to cancel scheduled activities for any reason that makes it impossible to offer the activity with the required quality and safety or because there is not the minimum number of members required. In this case, the partners will be notified as much in advance as possible, always more than 48 hours in advance, and the credits used will be fully returned.

Activities and Trips of the Neptuno Navigation Club

From the Neptuno Nautical School we offer you the option of participating in the activities, events and trips programmed by the NEPTUNO NAVIGATION CLUB and not exclusive for members. So you can browse without monthly fees or commitment to permanence.

To book your sailing trips you must do so through the forms enabled in this regard on our Website or through the rest of our enabled channels.

The generic cancellation policy, except for particular conditions that may be indicated in the information of each trip/event/course, is reflected in the following table, indicating the amount to be refunded in the event of cancellation by the client:

Neptuno Navigation Club trips outside of Spain

The Neptuno Nautical School offers sailing trips, in different locations outside of Spain, through the “place by place” modality. They are offered through Neptuno Viajes SL, authorized as a travel agency.

Members of the Neptuno Navigation Club can use their credits to book trips and have a more favorable cancellation policy.

The generic cancellation policy, except for particular conditions that may be indicated in the information of each trip, is reflected in the following table, indicating the amount to be refunded in the event of cancellation by the client:

Neptuno Viajes SL reserves the right to cancel scheduled activities for any reason that makes it impossible to offer the activity with the required quality and safety or because there is not the minimum number of clients required. In this case, members will be notified as much in advance as possible, always more than one month in advance, and the amount paid will be fully refunded.

Boat rental

At the Neptuno Nautical School we offer you the opportunity to rent different types of boats in the Port Olímpic of Barcelona, ​​always with a professional skipper.

To do this, you must contact us through the email info@neptuno.es

Once we receive your request, we will contact you within a maximum of 24 hours to specify and give you all the information you need.

You may withdraw from the reservation within 14 days of making it, in which case we will refund the amount paid.

Changes to the rental dates will have no cost, although if the change is requested in the last 24 hours before the date on which the rental would take place, the cost of the skipper(s) will be charged separately. If it is not possible to change the rental date, the cancellation of the reservation will involve a penalty of 30% of the amount, unless this is requested within the last 48 hours prior to the time of rental, in which case the penalty will be of 50%.

If you wish to cancel the rental because bad weather conditions are expected on the day of navigation that do not allow navigation, according to the criteria of the Barcelona Maritime Captaincy, no penalty will be charged for said cancellation. If the conditions are not good but navigation is allowed, the cancellation conditions and/or date changes will be those indicated in the previous section.

Management

From the Neptuno Nautical School, we can offer you the management of different procedures related to nautical qualifications, such as the payment of fees for registering for an exam or the renewal of a title.

You can contract the available procedures through your online campus or by contacting the school by telephone or through info@neptuno.es.

Teaching platforms

From the Neptuno Nautical School we put at your disposal the "online campus" platform that includes all the teaching material for your recreational nautical courses "virtual classroom", allows you to reserve the contracted practices and allows you to contract procedures and training activities additions. Access to said online campus can be paid and/or free, usually forming part of a contracted course.

When purchasing a Course, you will be able to access the Payment Platform through the confirmation information that we will send you by email. Once you have registered and access your Course, you must bear in mind that, depending on the modality chosen, you must meet or not meet certain deadlines to complete the Course satisfactorily. The duration of access to the virtual classroom is variable for each course and is described on our website. By default they are 1 month for the pleasure boat skipper course, 3 months for the yacht skipper course and 6 months for the yacht captain course.

Blog

We have a blog (“Blog”), which is an integral part of the Website and in which, from time to time, we will upload content so that you can have access to information about the Neptuno Nautical School, navigation and information that may be useful to you.

Card and Gift Voucher

You can give a gift card (“Gift Card”) to the person you choose. To do this you must recharge said Gift Card through our website. It is important to keep in mind that, in order to give the Gift Card, you must recharge it with at least the minimum amount indicated on the Website.

The Gift Card does not expire, that is, it can be used as many times as you want until the balance is exhausted.

If you want to give a specific Product and/or Service as a gift, we give you the option of giving a Gift Voucher (“Gift Voucher”) so that the person you choose can exchange it for the chosen Product and/or Service.

Once that person receives the Gift Voucher, they must contact us so they can decide when to redeem it.

The person who receives the Card or Gift Voucher may only redeem it for the Products and/or Services for which they meet all the required and detailed requirements for each of the Products and/or Services, as detailed on our Website.

7. PRICE AND PAYMENT METHOD

Price

The prices of the Products and/or Services are those that appear on the Website at the time you place the order (includes the applicable taxes in each case) or those that appear in the pamphlets and/or advertising dossiers for the established validity period. in them.

Prices may change at any time, but possible changes will not affect orders for which a Purchase confirmation has already been sent, except when payment of the Course price is made by deferred payment, since, if Full payment for the Course has not been made within three months, the update of the Course price could be applied to the amount pending payment.

For both professional and recreational Courses, you have 12 months to complete the contracted course. If within this period, counted from the moment of the first payment, the Course is not carried out, the money paid up to that point will be lost and a new registration will be necessary to complete the Course.

In the event that you would like to take a Course other than the one reserved and you have already paid the deposit, you can request a change of Course and use the money paid as a deposit to reserve this new Course.

In some cases, the payment of the course and/or trip is allowed to be divided into 3 monthly payments. In this case, the Neptuno Nautical School reserves the right to allow certain contracted activities to be carried out, such as sailing practices in recreational nautical courses.

Payment method

Once you have selected the Products and/or Services you wish to purchase, these will be added to your cart, and the next step will be to process the Purchase and make the payment. To do this, you must follow the steps of the Purchase process, filling out or verifying the information requested at each step. Likewise, during the Purchase process, before making payment, you can modify the details of your order. All charges made will be detailed prior to the purchase confirmation, including a breakdown of prices and applicable taxes.

You can use the means indicated on the Website as payment methods. Payment can also be made through bank transfer, through credit card and/or cash at our offices. Escuela Náutica Neptuno reserves the right to suspend the processing of the order in the event of rejection of the payment authorization by the bank or payment entity in question in each case.

All transfers and payments made through the Web are made through secure ports to guarantee data protection. All data travels encrypted through the secure payment platforms of the gateways, and is not stored.

8. TECHNICAL MEANS TO CORRECT ERRORS

9. CANCELLATION POLICY, REFUNDS AND RIGHTS

Right of Withdrawal

In general, as a consumer and user for the purposes of the applicable regulations, you have the right to withdraw from Purchases within a period of 14 calendar days without the need for justification. The withdrawal period will end 14 days from the day the contract is concluded. After that period, we will not return any deposits or the price paid for the Course, except as indicated in clause 7 above. Likewise, if you are late in paying for the Course or the Course price is not paid in full before the scheduled start date, the amount paid will not be refunded, except as indicated in clause 7 above, as This payment represents the reservation of the place.

Keep in mind that, if you start the training before 14 days have passed since the Course Purchase, you will not be able to withdraw from the Purchase made.

However, some Courses and/or Products or Services may have specific deadlines according to their special characteristics, both for withdrawal and modification. Please carefully review the instructions for this purpose at the time of reservation or purchase.

To exercise the right of withdrawal, you must contact us by email at info@neptuno.es, indicating in the subject your name and “EXERCISE RIGHT OF WITHDRAWAL” and your decision to withdraw from the Purchase through an unequivocal statement.

In case of withdrawal in accordance with the above, from the Neptuno Nautical School we will return all payments received, except for shipping costs if any, without any undue delay and, in any case, within 14 calendar days. from the date on which you communicate your decision to withdraw from the Purchase. The refund will be made using the same payment method that you would have used to make the Purchase, unless you indicate otherwise, without incurring any additional costs as a result of the refund.

Effects of Withdrawal

In accordance with current regulations, when a part of the Product and/or Service has already been provided, at the time you inform us of your willingness to exercise your right of withdrawal, only the amount proportional to the part not provided will be returned to you and/or or consumed of the Product and/or Service. The proportional amount will be calculated based on the total price agreed upon at the time of Purchase and/or reservation.

10. RESPONSIBILITIES

However, unless otherwise provided by law, no liability will be accepted for the following losses, regardless of their origin:

Escuela Náutica Neptuno does not assume responsibility of any kind for non-compliance and/or lack of attention or respect for the training standards of the Escuela Náutica Neptuno, the instructions of the instructors and/or teachers or the other regulations applicable to the courses and that is provided to the student prior to training. All regulations are mandatory to carry out the courses, insofar as they are applicable.

11. TRANSFER OF RIGHTS AND OBLIGATIONS

These Terms and Conditions constitute a binding contract both for you, as a User, and for us, as well as for the respective successors, assigns and assigns. You may not transmit, assign, encumber or in any other way transfer the contract or any of the rights or obligations derived from it, without having obtained prior written consent from Escuela Náutica Neptuno.

From the Neptuno Nautical School we may transmit, assign, encumber, subcontract or in any other way transfer the contract or any of the rights or obligations derived from it, at any time during its validity.

For the avoidance of doubt, such transmissions, assignments, liens or other transfers will not affect the rights that, if applicable, you have as a consumer recognized by law nor will they cancel, reduce or limit in any other way the guarantees, both express and tacit, that are they could have granted.

12. FORCE MAJEURE

We are not responsible for any failure or delay in the fulfillment of any of the obligations assumed, when it is due to events that are beyond our reasonable control ("Cause of Force Majeure").

Causes of Force Majeure will include any act, event, failure to perform, omission or accident that is unforeseeable or unavoidable and, therefore, is beyond our reasonable control.

It will be understood that the obligations will be suspended during the period in which the Cause of Force Majeure continues, and we will have an extension in the term to comply with said obligations for a period of time equal to the duration of the Cause of Force Majeure. From the Neptuno Nautical School we will use all reasonable means to end the Cause of Force Majeure or to find a solution that allows us to comply with our obligations despite the Cause of Force Majeure.

13. RESIGNATION

The lack of requirement, on our part, of strict compliance by the Users of any of the obligations assumed under the contract or these Terms and Conditions, or the lack of exercise on our part of the rights or actions that may correspond under of the contract or these Terms and Conditions, will not imply any waiver or limitation in relation to said rights or actions nor will it exonerate you from complying with such obligations.

No waiver by us of a specific right or action will constitute a waiver of other rights or actions derived from the contract or these Terms and Conditions nor will it be effective, unless it is expressly established that it is a waiver and is formalized and communicated to the User in writing.

14. INTELLECTUAL PROPERTY

The information disseminated on the Web, as well as its contents (the “Web Contents”) are owned by the Neptuno Nautical School or its authors and are considered protected works in accordance with the provisions of Royal Decree 1/1996, of April 12, which approves the consolidated text of the Intellectual Property Law. Said Training Contents are protected from unauthorized copying and downloading on the Neptuno Nautical School Platforms, and although they can be used as study and training material, in no case can it be understood that at the Neptuno Nautical School we assign or authorize our Users to exploit in any of its forms the rights over said Training Content.

The brands, trade names or distinctive signs of any kind that appear on the Website are the property of the Neptuno Nautical School or have been published with the consent of their legitimate owners, without it being understood that access to the Website attributes to the Users any right over the aforementioned trademarks, trade names and/or distinctive signs.

18. RIGHT TO MODIFY THE TERMS AND CONDITIONS AND COURSES

At the Neptuno Nautical School we have the right to review and modify these Terms and Conditions at any time, so we are not responsible for any damage that you as a User may suffer due to their change. 20. APPLICABLE LAW AND JURISDICTION

The use of the Website and contracts for the Purchase of Products and/or Services through the Website are governed by Spanish legislation. Any controversy that arises or is related to the use of the Website or with said contracts will be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.
